The US EPA has issued a proposed rulemaking to grant Utah primacy for Class VI carbon dioxide injection wells under Section 1422 of the Safe Drinking Water Act.
Approval would transfer regulatory oversight for geologic sequestration permitting from federal jurisdiction to the Utah Division of Oil, Gas and Mining (UDOGM).
The EPA has scheduled a virtual public hearing for December 3, 2026, and will accept written public comments through December 7, 2026.
The Environmental Protection Agency (EPA) has issued a formal public notice proposing to approve the State of Utah’s application for primary enforcement authority over Class VI carbon dioxide injection wells under Section 1422 of the Safe Drinking Water Act (SDWA).
Utah originally submitted its formal primacy application on December 23, 2025. Upon final regulatory approval, primary administration and enforcement of the Underground Injection Control (UIC) Class VI framework within state borders will transfer from federal EPA regional oversight to the Utah Division of Oil, Gas and Mining (UDOGM).
The regulatory milestone aligns with ongoing state-level efforts across the U.S. Intermountain West to accelerate carbon capture, utilization, and storage (CCUS) project deployment by streamlining environmental permitting processes for long-term subsurface carbon sequestration.
Under the proposed rulemaking, UDOGM will be authorized to process, issue, and enforce Class VI permits for industrial carbon storage projects in compliance with minimum federal SDWA protective standards.
To support the administrative record ahead of a final determination, the EPA has established a public consultation process:
Public Hearing: A virtual public hearing will be conducted via Zoom on Thursday, December 3, 2026, from 5:00 to 7:00 pm MDT, allowing registered stakeholders to present oral testimony subject to a three-minute limit per commenter.
