Blue Wave, Same Regulators: What a Democrat-led Congress Means for Crypto Regulations

It's official: Democrats will control both chambers of Congress from January 3, 2027.

That's a clear shift from the last two years, when Republican majorities ran both the House and the Senate and steered crypto's market structure bill through the House, though the Clarity Act failed at a mid-September vote in the Senate.

Democrats have generally pressed for stricter consumer protection, ethics rules on officials' crypto income and tougher anti-money-laundering controls, while Republicans have generally led the push for dedicated crypto laws that give the industry clear rules, faster.

The GENIUS Act will take effect anyway, despite the ‘blue wave’ from these midterm elections

The CLARITY Act did pass the House with votes from both parties

The SEC, the CFTC and the veto pen stay with the president until January 2029. So, the shift could be smaller than the headline suggests. Let's break it down.

Democrats won both chambers after the November 3 vote, and by more than expected.

In the Senate, they reached 54 seats after flipping seven Republican-held seats: Iowa, Kansas, Maine, North Carolina, Ohio, South Carolina and Texas.

In the House, Democrats  won well over the 218 seats needed for a majority.

The House flip was largely priced in but maybe not at that scale.

Kalshi traders put a Democratic House near 90% in mid-October but a Democratic Senate at 63%, while Kansas and South Carolina were not among the races seen as closest before the vote.

In short, the US midterm elections have resulted in a so-called “blue wave”.
