The US has suspended eight tech companies from the PERM green-card programme. Here’s what Indian IT professionals need to know about pending applications, existing H-1B visas and alternative routes to permanent residency.

The US government has suspended eight technology companies — Infosys, Tata Consultancy Services (TCS), Wipro, HCLTech, Cognizant, Capgemini, Microsoft, and Adobe — from the Permanent Labor Certification (PERM) programme, a route through which employers sponsor foreign workers for employment-based green cards.

I am hereby suspending from the Permanent Labor Certification Program some of the largest IT outsourcing firms in the world — Cognizant, Infosys, Tata, Wipro, HCL, and Capgemini — and also, due to multiple active federal investigations, @USDOL is suspending Microsoft and Adobe...

Sonderling said the department would not accept new or process pending permanent labour-certification applications involving the companies.

Our message to Microsoft and to any other foreign or domestic corporation is quite simple. We obviously want you to thrive in the US. We want people to invest in the US, particularly the American technology sector. We’re the biggest boosters of your industry. We want you to continue to grow and to employ a lot of people, but we want you to employ American workers.

Here is what Indian IT professionals and other affected employees need to know:

1. What is PERM, and why is it important for a green card?

PERM, or Permanent Labor Certification, is a US Department of Labor process that generally requires an employer to demonstrate that there are not enough qualified and available US workers for a particular job and that hiring a foreign worker will not adversely affect the wages and working conditions of similarly employed American workers.
