Judge Edward Davila today formally established the schedule for Apple’s trade secrets misappropriation lawsuit against two former employees, OpenAI, and io Products, including a trial date. Here are the details.
A couple of weeks ago, during an October 14 case management conference, Judge Edward Davila instructed Apple and the defendants to agree on a proposed schedule for the lawsuit, working toward a tentative trial date of July 19, 2027.
The parties were given until October 23 to submit their proposed schedule, which the judge has now formally established.
As we’ve been covering since July, Apple filed this lawsuit accusing the defendants of improperly accessing or using confidential information about its products and technologies to help advance OpenAI’s consumer hardware development efforts.
In recent days, Apple scored two procedural wins in its efforts to obtain expedited discovery, with Judge Davila granting the company access to additional documents and information from the defendants ahead of the normal discovery process.
In a case management order issued today, Davila established July 19, 2027, at 9 a.m. as the official trial date, with additional deadlines for discovery, motions, and pretrial proceedings in the meantime.
Notably, the schedule includes a June 1 deadline for the lead attorneys on both sides to meet and discuss a potential settlement.
To be clear, this is a common procedural step in federal civil lawsuits and does not necessarily indicate that Apple and OpenAI are considering settling the case.
